Update from Mayor SindelarDuring Wednesday night’s meeting, Mayor Bobbi Sindelar read the following statement: The Board believes that it is of the utmost importance that it be transparent as to the current situation regarding Chief Montgomery. As the Board has been advised that the Director of Safety Services has determined that numerous policies, procedures and practices of the Police Department are not in compliance with applicable law or best practices there is a desire that such findings be audited by an independent third party.
I recommend that the Mayor Pro Tem be appointed to lead a search and recommend a qualified individual or firm to the Board for its approval. Certainly, Mayor Pro Tem will seek the advice and assistance of individual Trustees.
I ask for patience as the Board is seeking to resolve this matter as expeditiously and fairly as possible for all involved and we assure the citizens that the Police Department remains devoted to fulfilling its public safety duties to the community.
The Board of Trustees approved appointing Mayor Pro Tem Jimenez to lead a search for an independent third party to conduct an audit of the Safety Services Director’s findings.

IGA with City of Fort LuptonDuring Wednesday night’s meeting, the Board of Trustees approved an Intergovernmental Agreement (IGA) with the City of Fort Lupton. In January of this year, Town staff learned of a proposed Fort Lupton annexation that would have included CR-19. Upon learning of the proposed annexation, Town staff began taking steps to secure CR-19, south of CR-24, as the Town’s eastern boundary. In February, Town staff began working with the City of Fort Lupton staff to establish a shared boundary and prepare the IGA.
The agreement establishes CR-19 (to the east edge of the future right-of-way line) as Firestone’s eastern boundary and within the Firestone Planning Area. East of that line is within Fort Lupton’s. It also memorializes that, during the agreement, land east of the boundary can only annex into Fort Lupton and to the west only into Firestone.

Cooperative Development Plan with Kerr-McGee ApprovedThe Board of Trustees approved a Cooperative Development Plan Agreement with Kerr-McGee Oil & Gas Onshore LP (Kerr-McGee) during Wednesday night’s meeting.
Town staff has been negotiating the Cooperative Development Plan Agreement with Kerr-McGee since 2019. Modeled after a similar agreement with Crestone, the agreement provides continued energy development and production while mitigating its impacts on the community. As stated in the agreement, the intent is to supplement State of Colorado rules for oil and gas development and production for up to 33 wells at two locations in Firestone. The agreement includes operational standards to mitigate impacts during the drilling, completion, and flow backstages; including noise, odor, and lighting. This agreement does not permit any oil and gas activities at both sites. Kerr-McGee will go through separate public processes with the COGCC and Town to actually receive permits for any oil and gas activities on both sites.

Turner Commons Filing No. 1 Final Plat & Final Development PlanIn separate actions during Wednesday night’s meeting, the Board of Trustees approved Resolution 21-44, the Turner Commons Filing No. 1 Final Plat (Final Plat), and Resolution 21-45, the Lot 3 Turner Commons Filing No. 1 Final Development Plan (FDP). This property is located northwest of the intersection of Highway 119 and I-25. The Final Plat and FDP approvals are the final steps in the Firestone Development Regulations process before the building permit process. Final Plat The Final Plat creates three developable lots and one tract for access to the development and future access to the properties to the north. Access to the overall property is from the north leg of the intersection of Hwy 119 and Turner Boulevard.
Final Development Plan Lot 3 of Turner Commons Filing No. 1 is approximately 2.98 acres in size and is proposed to be developed with a 4,993 square foot commercial convenience store building (QuikTrip) and the associated fueling facility (9 double-sided stations), parking, and landscaping.

Construction Contract Approved for the Public Works Expansion & Remodel ProjectDuring Wednesday night’s meeting, the Board of Trustees approved Resolution 21-50, a construction contract for the Public Works expansion and remodel project with BlueScope Construction.
The current Public Works Facility lacks the means to support the staff’s needs at the facility adequately. This project will improve the existing building’s conditions while adding the necessary space for staff to work efficiently.
The existing building consists of approximately 12,250sf single-story storage building with office, restroom, and breakroom area at the north end. The expansion and remodel will add 8,000sf of shop area to the south of the existing building. The current office and restroom area will be reconfigured for larger restrooms, added offices, and an enlarged breakroom on the north end. The existing wood-framed mezzanine will be reconstructed in a larger area to include offices and general storage. This project will also have a wash-bay to maintain compliance with the Town’s MS4 permit when washing fleet units. In addition to the expansion and remodel, the Town will install over 3,000 LF of sanitary sewer to connect the facility.
Construction is anticipated to begin in early May and be complete by early Fall.
